Panel Applications

The Centre has two separate Panels based on whether the arbitraiton is classed as domestic or international. These panels are the Centre’s Domestic Panel of Arbitrators and the Centre’s International Panel of Arbitrators.

Period of Panel membership

Membership of either panel, which may be by invitation or application, will be for a period of three years renewable at the invitation of Centre, ending on 31st December of the third year.

Domestic and international disputes

Unless all parties agree otherwise, appointments by the Centre in relation to international disputes (disputes involving at least one party who is not based in Scotland), will normally be made from the International Panel. Other appointments will normally be made from the Domestic Panel of Arbitrators.

Committee

Following the initial setting up of these Panels, the Panel Appointments Committee will meet twice each year. Each application will be reviewed by the Centre’s Secretariat to ensure that the candidate appears to meet the required selection criteria. If the criteria appear to be met, the Centre will inform the applicant that his or her application will be tabled at the next Panel Appointments Committee meeting. The Committee may ask for further information from the candidate before making a decision.

Criteria

International Panel

 

Normally, this panel will comprise persons who have demonstrated extensive experience as arbitrators or as judges. Normally, individuals included on the International Panel will be experienced members of the arbitration community who have been appointed as arbitrators in multiple international disputes and have significant knowledge of international arbitration law and practice.

In general, persons who are not Chartered Arbitrators of the CIArb will not be considered for membership of the International Panel.

An arbitrator who wishes to apply for inclusion on the International Panel must:

  1. have issued at least six arbitration awards;
  2. provide a copy of his or her latest curriculum vitae;
  3. provide copies of three sanitised arbitration-related documents, two of which must be awards;
  4. provide two written references;
  5. confirm that they have not been found guilty of misconduct by any court or disciplinary tribunal.

However, eminent persons with substantial relevant experience but who do not otherwise meet the requirements above may be included in the International Panel.

Domestic Panel

An arbitrator who wishes to apply for inclusion on the Domestic Panel must:

  1. have issued at least two arbitration awards;
  2. demonstrate at least five years’ experience in arbitration or litigation as arbitrator, judge, advocate, instructing solicitor, expert witness, or in any other similar capacity;
  3. be a Fellow of the CIArb or demonstrate a similar level of knowledge of arbitration law and practice;
  4. provide a copy of his or her latest curriculum vitae;
  5. provide copies of two sanitised arbitration-related documents, one of which must be an award;
  6. provide two written references;
  7. confirm that they have not been found guilty of misconduct by any court or disciplinary tribunal; and
  8. be resident in Scotland.

In exceptional circumstances, persons with substantial relevant experience who do not otherwise meet all of the requirements listed above may be considered.
