A number of arbitral institutions now offer expedited arbitration procedures. The demand is for cost efficiency and clearly defined timeframes. This talk examines recent development with other arbitration rules and institutions and reflects on how the Scottish Arbitration Rules can meet this demand. It also looks at guidance from the courts on recent challenges to arbitral awards.
Lindy Patterson acts as arbitrator, adjudicator and dispute board member in the construction and engineering; energy and PPP sectors. Lindy is qualified in English and Scots law operating internationally and in the UK. Lindy is on the FIDIC President’s List of international Adjudicators. Other credits include President-Elect of the Dispute Resolution Board Federation (DRBF) Region 2, part of the Conflict Avoidance Panel administered by the Royal Institution of Chartered Surveyors for the infrastructure company, Transport for London, a Fellow of the International Academy of Construction Lawyers and Chair of Arbitral Appointments Committee (domestic) of the Scottish Arbitration Centre and member of the London Court of International Arbitration. Lindy also teaches on the International Arbitration Masters Course at the University of Edinburgh and is a senior tutor in construction law. Prior to joining 39 Essex Chambers, Lindy was a partner and solicitor-advocate with CMS Cameron McKenna representing clients in LCIA; ICC and LMAA arbitrations as well as non-institutional arbitrations including UNCITRAL and CIArb. Her experience is of operating in both civil and common law jurisdictions including – Albania; Denmark; Finland; Iraq; Malaysia; Romania; Serbia; and Switzerland.
